Welcome to CocoCount

Welcome to CocoCount ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of the CocoCount mobile application and related services (collectively, the "Service"). By using CocoCount, you agree to be bound by these Terms.

Acceptance of Terms

By accessing or using CocoCount, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access the Service.

Description of Service

CocoCount is a family task management application that helps parents and children organize tasks, manage rewards, and track family activities. The Service includes:

  • Task Management: Create, assign, and track family tasks
  • Rewards System: Manage points and redeem rewards
  • Family Accounts: Parent and child account management
  • AI Chat: Optional AI-powered chat feature for children (with parental oversight)
  • Notifications: Push notifications and reminders
  • Alexa Integration: Voice commands through Amazon Alexa

User Accounts

Account Creation

  • Parent Accounts: Only parents or guardians may create family accounts
  • Child Accounts: Parents create and manage child accounts
  • Age Requirements: Children as young as 4 years old may have accounts (when they can read)
  • Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials

Account Restrictions

  • One Family Account: Each family may have only one primary account
  • Parental Control: Parents have full control over child accounts and data
  • Feature Limitations: Child accounts have restricted functionality compared to parent accounts

Subscription and Payment

Paid Service

CocoCount requires a subscription for full access to features.

Payment Processing

  • App Store/Google Play: All payments are processed through Apple App Store or Google Play
  • No Direct Billing: We do not collect or store payment information
  • Subscription Management: Manage subscriptions through your app store account

Refund Policy

Refunds are handled according to Apple App Store and Google Play refund policies.

Acceptable Use

Permitted Use

You may use CocoCount only for lawful purposes and in accordance with these Terms.

Prohibited Activities

You agree not to:

  • Use the Service for any illegal purpose
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Attempt to gain unauthorized access
  • Interfere with the Service's operation
  • Use automated tools or bots
  • Share account credentials
  • Create multiple accounts for the same family

Content and User Data

User Content

  • Ownership: You retain ownership of content you create
  • License: You grant us a license to use your content to provide the Service
  • Responsibility: You are responsible for content you create and share

Family Data Sharing

  • Family Sharing: Data is shared among family members as part of core functionality
  • Parental Oversight: Parents can view and manage all family data
  • Data Deletion: Parents can delete child data at any time

AI Chat Feature

How AI Chat Works

  • Third-Party Providers: AI responses are generated by third-party AI providers. Our current primary provider is Google Cloud's Vertex AI (Gemini models), with other providers (for example OpenRouter, OpenAI, or Anthropic) used as fallbacks or for specific features. The set of providers may change over time as we add, remove, or reroute traffic between them; current providers are listed in our subprocessor disclosures and privacy policy.
  • Data Sent: When you use AI chat, the content of your messages is transmitted to the provider handling that request so a response can be generated.
  • No Training: We contract with our AI providers under terms that prohibit use of your chat content to train their models, and chat data is not used by CocoCount for profiling.

Accuracy

  • Not Professional Advice: AI responses may be inaccurate, incomplete, or out of date. Do not rely on AI chat for medical, legal, financial, safety, or other professional decisions.
  • Parental Review: Parents should review AI interactions, especially for younger children, and use their own judgment before acting on AI-generated content.

Usage Limits

  • Fair Use: AI chat is subject to fair-use limits that may vary by plan and may change over time to ensure service availability for all families. When a limit is reached, you will be asked to wait before sending again.
  • No Guaranteed Capacity: We do not guarantee a specific number of AI messages per hour, day, week, or subscription period.

Children's AI Chat

  • Parental Consent: AI chat is enabled only with parental consent.
  • Parental Oversight: Parents can view all child chat conversations.
  • Content Filtering: We use automated filters to reduce sharing of personal information.

Chat Restrictions

  • Appropriate Content: Keep conversations appropriate for children.
  • Personal Information: Do not share sensitive personal information.
  • Supervision: Parents should monitor child usage.

Privacy and Data Protection

Privacy Policy

Your use of CocoCount is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Data Collection

We collect information as described in our Privacy Policy, including:

  • Account information
  • Usage data
  • Device information
  • Chat messages (with parental oversight)

Data Security

We implement reasonable security measures to protect your data, including encryption and access controls.

Intellectual Property

CocoCount IP

  • Ownership: CocoCount and its original content are protected by intellectual property laws
  • License: We grant you a limited license to use the Service
  • Restrictions: You may not copy, modify, or distribute our intellectual property

User Content

  • Your Rights: You retain rights to your content
  • Our License: You grant us rights to use your content for Service provision

Termination

Account Termination

  • By User: You may delete your account at any time
  • By Us: We may terminate accounts for Terms violations
  • Data Deletion: Account deletion includes data removal as described in Privacy Policy

Effect of Termination

Upon termination:

  • Your access to the Service ends
  • We may retain some data as required by law
  • Your data is deleted according to our retention policy

Disclaimers

Service Availability

  • As-Is: Service provided "as is" without warranties
  • No Guarantees: We do not guarantee uninterrupted service
  • Third-Party Services: We are not responsible for third-party integrations

Limitation of Liability

  • Maximum Liability: Limited to amounts paid for the Service
  • Indirect Damages: We are not liable for indirect or consequential damages
  • Force Majeure: We are not liable for events beyond our control

Indemnification

You agree to indemnify and hold us harmless from any claims arising from your use of the Service or violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.

Dispute Resolution

Informal Resolution

We encourage you to contact us first to resolve disputes informally.

Arbitration

Any disputes not resolved informally may be subject to binding arbitration.

Changes to Terms

Modifications

  • We may update these Terms from time to time
  • We will notify you of material changes
  • Continued use constitutes acceptance of changes
